(CBS News) Now that George Zimmerman is behind bars facing murder charges for shooting Trayvon Martin in Sanford, Fla. on Feb. 26, there are questions about just how strong a case prosecutors have against him.
Special prosecutor Angela Corey’s affidavit outlines her case, saying, Zimmerman “profiled” Martin as a suspicious person, and became the aggressor when he “disregarded the police dispatcher” on this call.
Corey said, “If (the) ‘Stand Your Ground’ (law) becomes an issue, we will fight it.”
But many criminal trial lawyers in Orlando see nothing in the special prosecutor’s affidavit that would convict Zimmerman.
Florida’s “Stand Your Ground” law allows even the original aggressor in a fight to use deadly force – if that person becomes reasonably afraid of being killed or seriously hurt.
Trial lawyer Richard Hornsby has litigated 15 “Stand Your Ground” cases – none of them homicides – and won them all.
Hornsby told CBS News he thinks Corey’s affidavit is more significant for what it leaves out than for what it includes.
“The moment George Zimmerman fired that shot is the key question in this entire case,” Hornsby said. “Did he reasonably believe he had to fire that shot to defend himself? And the fact (Corey) completely left that out, begs the question, does she not have any evidence to refute his version of the events?”
A hearing next Friday will determine whether Zimmerman should be freed on bond.

This prosecutor is doing her job. So many want to let Zimmerman off the hook. This was clearly a racially motivated killing. I try to stay out of this because most viewers here seem to go along with the right wing, as incited by Fox News and the Rush Limbaughs out there, and it’s difficult to convince them that racism in this nation is real. Thank goodness the majority in this nation are calling it what it is. 500 years of terrorism in this country and there are still those trying to convince us that blacks aren’t under attack. Here are some things to think about:
Why the right wing can’t fully attack Zimmerman
“Because if they admit that Trayvon Martin was murdered because of racism, that means racism exists.
If racism exists in Florida, it probably exists in the United States.
And if it exists in the United States, it’s probably directed at our first black president.
So admitting Trayvon Martin was murdered because people are racist, is an admission that some people probably hate the President because simply because he’s black.
And that’s something the GOP water carriers can’t admit, or address.
So it’s about the Birth Certificate. Or Socialism. Or a war on religion. Anything to dodge the conversation.
And so – to continue dodging the conversation – George Zimmerman HAD to be in the right. Or Trayvon had to be asking for it.
Because otherwise, it’s an admission that there are people who will vote for ANY GOP candidate simply because they don’t like blacks, and vote against Obama simply because of the color of his skin.
And votes are votes, folks.”
